European court rules against Spanish consumer law in mortgage case
March 18, 2013The European Court of Justice last week ruled against a Spanish bank that was trying to evict the owner of a property despite him appealing unfair terms in his mortgage contract.
The ruling is widely being reported as being against abusive Spanish mortgage law, which is actually incorrect. The ruling is in fact about unfair terms in consumer law, which in this case affected the owner’s mortgage.
